In Focus – Plastic Surgery Malpractice Claims

Medscape in 2017 published a research study involving the analysis of 93 plastic surgery medical malpractice cases from the Westlaw database between 2009 and 2015.

Statistics gleaned from this study in the final analysis showed 61 cases favored for the defendant (65.6%), 22 favored the plaintiff (23.7%), and 10 cases were settled.(1)

According to this 2017 Medscape study, what allegations do plastic surgeons face most commonly in malpractice claims?

  • Breast surgery (34.4%)
  • Liposuction (18.3 %)
  • Body Contouring (14%) (2)

Broken down by state in this study, found New York to be the 2nd highest in number of legal cases (18.3%) with California having the greatest number of legal cases at 26.9%. (3)

With respect to patient safety, patient selection is enormously important in plastic surgery. “The identification of patients and procedures that have an increased risk of complications enables the physician to carry out prophylactic measures to reduce the rate of these complications.” (4) Thorough preoperative patient evaluation, detailed informed consent, and perioperative care delivered in a safe environment will all contribute to improved safety in plastic surgery.
